Albert L. Elder. III
Al Elder is an experienced attorney in banking and financial services, business and consumer matters. He has substantive experience in resolving complex legal issues as a private litigation attorney, federal government attorney, national trade association attorney and mortgage finance attorney. Some of his prior positions are summarized below.
Background
Chief Banking Officer for the District of Columbia
As the District of Columbia’s Chief Banking Officer, Mr. Elder chartered the first District-chartered bank in the history of the District of Columbia and ensured the adoption of related legislation that provided District banks operational parity with other state-chartered banks.
Under his direction, the Department of Banking Department and Financial institutions adopted the Money Transmitters Regulation, the Automatic Teller Machine Regulations, amendments to the Predatory Lending Regulations, and proposed broad District- chartered credit union powers and enhanced securities powers for District- chartered banks.
Further, he negotiated a settlement with a large national mortgage lender resulting in significant monetary payments to District of Columbia consumers who were victimized by abusive and predatory lending practices.
Attorney Advisor --- Office of the Comptroller of the Currency U.S Department of Treasury
As Counsel for the Office of the Comptroller of the Currency (“OCC”), U.S. Department of Treasury, Mr. Elder provided legal advice and analysis to the Washington Office of the OCC; all twelve OCC regional offices around the country; and individual national banks. Further, he authored rules related to Dealing in Gold, Operating Subsidiaries, and Investment Securities.
Government Relations Representative and Special Counsel, America’s Community Bankers
Mr. Elder authored and lobbied various bankruptcy, unitary thrift holding company and housing amendments and assisted in incorporating these amendments into law. In addition, he conveyed banking industry positions to Congress and the White House and analyzed legal issues in the banking, housing, and bankruptcy areas. Further, Mr. Elder represented ACB before federal agencies.
Vice President – Chief Counsel and Director of Compliance –A National Mortgage Corporation
In this capacity, Mr. Elder led a team of lawyers, examiners, license specialists and consultants in developing a comprehensive Mortgage Compliance Matrix. The Matrix contained a system for ensuring appropriate individual loan officer licensing, pre-closing audits, post-closing audits, quality assurance, and compliance reviews. A number of state examiners concluded that this system was the most comprehensive broker control system in the Country. In addition, he worked with state banking commissioners across the country resolving state/federal legal and compliance issues.
Others
Mr. Elder has represented corporate and individual interest in litigation; served as Washington Counsel for the U.S. League of Savings Institutions; and served as an auditor for the U.S. Department of Housing and Urban Development.
